These terms govern your use of mrwinston.co.nz (“the Site”). By accessing or making a purchase, you agree to these terms. If you don’t agree, please don’t use the Site.
1. About This Site
mrwinston.co.nz is an independent online retailer. We are not affiliated with, endorsed by, or operated by Mr Winston Co. (the Australian fashion label founded by Karen and Ella Davidson in Melbourne, Australia). All product names, trademarks, and brand references remain the property of their respective owners. We sell products from our own inventory as an independent retailer.
2. Eligibility
You must be at least 18 years old (or have parental consent if younger) and capable of forming a binding contract to purchase from this Site. By placing an order, you confirm that the information you provide is accurate.
3. Pricing & Currency
All prices are listed in New Zealand Dollars (NZD) unless otherwise specified. International customers will see currency conversion at checkout via our payment provider; the actual amount charged depends on your bank’s exchange rate at processing time.
We reserve the right to correct pricing errors. If we discover a significant pricing error after you’ve ordered, we’ll contact you to either confirm the correct price or cancel the order with a full refund.
4. Stock Availability
We do our best to keep stock levels accurate, but occasional discrepancies happen — particularly for limited drops or fast-moving sale items. If we’re unable to fulfil your order due to stock issues, we’ll notify you within 48 hours and refund or offer an alternative.
5. Product Descriptions & Images
We aim for accuracy in all product descriptions and photography. Colours may appear slightly different on screen due to monitor settings, lighting in product photos, and individual variation in dyed fabrics. Minor variations are not considered defects.
6. Payment
Payment is required in full at checkout. We accept the payment methods displayed at checkout (credit card, debit card, and any other listed providers). Your card is charged at the time of order placement.

8. Intellectual Property
The site design, layout, original photography we’ve taken ourselves, and original written content on this Site are protected by copyright. You may not reproduce, distribute, or use them without written permission.
Brand names, product names, and logos belonging to Mr Winston Co. and other third parties remain the property of their respective owners. Their use on this Site is for descriptive purposes only and does not imply endorsement or affiliation.
9. Limitation of Liability
To the extent permitted by law, our total liability to you for any claim arising out of or relating to a purchase from this Site is limited to the amount you paid for the affected order.
Nothing in these Terms excludes any rights you have under the New Zealand Consumer Guarantees Act 1993 or other applicable consumer protection laws that cannot be lawfully excluded.
10. Acceptable Use
When using this Site, you agree NOT to:
- Place fraudulent orders or use stolen payment information
- Attempt to disrupt the Site’s operation or security
- Scrape, harvest, or copy content systematically
- Misrepresent your identity or affiliation
- Use the Site to harass, threaten, or harm others
11. Account Suspension
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or repeatedly abuse our return policy.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Significant changes will be communicated via email to registered customers where practical.
13. Governing Law & Disputes
These Terms are governed by the laws applicable to your transaction. Any dispute should first be raised with us by email so we can attempt to resolve it directly. If unresolved, you retain all rights available to you under your local consumer protection laws, including (for NZ customers) the Disputes Tribunal or Commerce Commission.
